Terms and Conditions

Effective date: 7 May 2026

These Terms and Conditions ("Terms") govern your access to and use of ZomaLinks, a software-as-a-service product operated by Zoma Living ("we", "us", or "our"). By creating an account, accessing the service, or making a payment, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. Acceptance and Eligibility

1.1. You may use ZomaLinks only if you are at least 18 years old, are a natural person, and are competent to enter into a contract under the Indian Contract Act, 1872. If you are using ZomaLinks on behalf of a company, partnership, or other entity, you represent that you have authority to bind that entity to these Terms.

1.2. You must provide accurate, current, and complete information during signup and keep it updated.

1.3. You may not use ZomaLinks if you are barred from receiving services under the laws of India or any other jurisdiction that applies to you.

2. The Service

2.1. ZomaLinks is a link-in-bio profile builder for Indian real-estate professionals. It lets you create a public profile page that displays your contact details, custom links, property listings, and content blocks under a unique username (zomalinks.com/yourname).

2.2. We may update, modify, suspend, or discontinue features at any time. We will give reasonable notice for material changes that adversely affect existing paying subscribers.

3. Account Registration and Security

3.1. ZomaLinks uses one-time-password (OTP) email authentication. You are responsible for keeping your registered email address secure.

3.2. You are responsible for all activity that occurs under your account.

3.3. Notify us immediately at support@zomalinks.com if you suspect unauthorized use.

4. Subscriptions, Free Trial, and Auto-Renewal

4.1. ZomaLinks offers paid plans (Pro and Business). New Pro subscribers begin with a 7-day free trial. Pro is a recurring subscription billed monthly (Rs. 199 per month) or annually (Rs. 1,999 per year). Business plans are quoted individually.

4.2. New Pro subscribers receive a 7-day free trial. The trial begins on the day you complete subscription authorization. No charge is collected during the 7-day trial.

4.3. By starting a Pro subscription you authorize us and our payment processor (Razorpay Software Private Limited) to charge your saved payment instrument on a recurring basis at the start of each billing cycle. The first charge occurs on the eighth day after your trial begins, unless you cancel before that date. Subsequent charges occur on the same calendar day each month or year (as applicable) until you cancel.

4.4. All prices are inclusive of applicable Goods and Services Tax (GST) where required.

4.5. We may change subscription prices with at least 30 days' written notice to your registered email. The new price applies on your next renewal after the notice period.

5. Cancellation

5.1. You may cancel your Pro subscription at any time from your account dashboard at Settings > Subscription. Cancellation takes effect at the end of the current billing cycle. You retain Pro features until that date.

5.2. After cancellation, your subscription ends at the next renewal date and your account is downgraded to a limited unsubscribed state. Your data is retained per Section 11. You may re-subscribe at any time.

6. Refunds

Refund eligibility, processing, and exceptions are described in our Refund and Cancellation Policy at zomalinks.com/legal/refund. That policy forms part of these Terms.

7. Acceptable Use

7.1. You agree not to: (a) post content that is unlawful, fraudulent, defamatory, obscene, infringing, or that misrepresents your identity, qualifications, or properties; (b) post property listings for properties you do not own or are not authorized to represent; (c) violate the Real Estate (Regulation and Development) Act, 2016 (RERA), the Information Technology Act, 2000, or any other applicable law; (d) attempt to gain unauthorized access to any account, server, network, or data; (e) reverse-engineer, decompile, or scrape the service except as expressly permitted by law; (f) use the service to transmit spam, phishing content, or malware; (g) impersonate any person or entity; (h) use automated means to register accounts or generate page views.

7.2. We may suspend or terminate accounts that violate this section, with or without prior notice, depending on severity.

8. Your Content and Licence to Us

8.1. You retain ownership of all text, images, video, and other content you upload to ZomaLinks ("Your Content").

8.2. You grant us a worldwide, royalty-free, non-exclusive, sub-licensable licence to host, store, reproduce, modify (only for technical purposes such as resizing or transcoding), display, and distribute Your Content solely to operate, promote, and improve the service. This licence ends when you delete the content or close your account, except where necessary for backups, log retention, or where we are required to retain it under law.

8.3. You represent that you have all rights necessary to grant the licence in Section 8.2 and that Your Content does not infringe any third-party right.

9. Our Intellectual Property

9.1. ZomaLinks, the ZomaLinks logo, the underlying software, design, and all related marks and code are owned by Zoma Living and protected by copyright, trademark, and other laws.

9.2. Nothing in these Terms grants you any right to use our brand assets except as needed to display the optional "Powered by ZomaLinks" badge that appears on profiles without an active Pro subscription.

10. Privacy

Your use of ZomaLinks is subject to our Privacy Policy at zomalinks.com/legal/privacy, which is incorporated into these Terms.

11. Data Retention and Deletion

11.1. We retain account data for as long as your account is active.

11.2. After account deletion, we delete personal data within 30 days, except for transaction records, audit logs, and information we are required to retain under tax, accounting, or other applicable laws.

12. Service Availability

12.1. We strive to keep ZomaLinks available 24x7 but we do not guarantee uninterrupted service. Planned maintenance, third-party outages, and force-majeure events may cause downtime.

12.2. We may add, change, or remove features. Material adverse changes to paid features will be notified at least 30 days in advance.

13. Termination by Us

13.1. We may suspend or terminate your access: (a) if you breach these Terms; (b) if required by law, court order, or government request; (c) to protect users, third parties, or the integrity of the service; (d) if your payment fails for more than 7 days after the due date.

13.2. On termination, your licence to use the service ends. Provisions of these Terms that by their nature should survive (including Sections 8.2, 9, 14, 15, 16, 17, 19, 20) survive termination.

14. Disclaimers

14.1. The service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted operation, to the maximum extent permitted by applicable law.

14.2. We do not warrant that listings posted by users are accurate, lawful, or RERA-compliant. Buyers and other users should independently verify any property information before relying on it.

15. Limitation of Liability

15.1. To the maximum extent permitted by law, our total cumulative liability arising out of or relating to these Terms or the service, whether in contract, tort, negligence, statute, or any other theory, shall not exceed the total subscription fees you paid us in the three (3) months immediately preceding the event giving rise to the claim, or Rs. 5,000, whichever is greater.

15.2. We shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, loss of goodwill, loss of leads, or loss of data, even if advised of the possibility of such damages.

15.3. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

16. Indemnification

You agree to indemnify, defend, and hold harmless Zoma Living, its directors, employees, and agents from and against any third-party claims, damages, losses, costs, and expenses (including reasonable legal fees) arising out of (a) Your Content, (b) your breach of these Terms, (c) your violation of any law or third-party right, or (d) your use of the service in a manner not authorized by these Terms.

17. Force Majeure

We shall not be liable for any failure or delay in performance caused by events beyond our reasonable control, including natural disasters, acts of war or terrorism, epidemics, government actions, internet outages, power failures, or third-party service disruptions.

18. Modifications to These Terms

18.1. We may modify these Terms at any time. The updated Terms will be posted at this URL with a new effective date.

18.2. For material changes, we will give at least 14 days' email notice to your registered address. Continued use after the effective date of the change constitutes acceptance.

19. Governing Law and Dispute Resolution

19.1. These Terms are governed by the laws of India, without regard to conflict-of-laws principles.

19.2. Subject to Section 19.3, the courts at Gurugram, Haryana shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms.

19.3. Either party may, at its discretion, refer a dispute to arbitration under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration shall be Gurugram, Haryana, and the proceedings shall be conducted in English by a sole arbitrator appointed jointly by the parties.

20. Miscellaneous

20.1. Entire agreement. These Terms, together with the Privacy Policy, Refund Policy, and any plan-specific terms, constitute the entire agreement between you and us regarding the service.

20.2. Severability. If any provision is found unenforceable, the remaining provisions remain in full effect.

20.3. No waiver. Our failure to enforce a provision is not a waiver of that provision.

20.4. Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or successor in connection with a merger, acquisition, or sale of assets.

20.5. Notices. Notices to you may be sent to your registered email. Notices to us must be sent to support@zomalinks.com and to the address in Section 21.

We acknowledge complaints within 24 hours and resolve them within 15 days, where feasible.
